Interviewer: Should you consider having a trust when you have the potential possibly of having members of your family who might be incapacitated?
Becky Cholewka: Incapacity planning is one of the best reasons to have a trust. Of course there’s always unexpected incapacity like a car accident. Things like that that we don’t foresee.
We have a lot of families that know that maybe there’s Alzheimer or dementia in their family and they know they have a possibility of going down that road. Maybe they are going in for some type of major surgery, and they want to make sure their plan is in place.
We can make sure with the trust that we can create that plan that will protect the families better than just having a will based plan. Trust planning is very good in those circumstances.
